What To Do Following a Motor Vehicle Accident

If you are injured due to someone else's negligence, we can help you receive compensation for your medical bills, lost wages, pain and suffering, permanent disability, scarring, disfigurement and changes in your lifestyle.

This is not something you should try to do on your own, since insurance companies want to pay you the least amount they can get away with. To protect your legal rights regarding injury that is the result of a motor vehicle accident, whether as an operator, passenger, or pedestrian, it is advisable to contact an experienced personal injury attorney as soon as possible.

Attorney Roger S. Weinberg has been helping clients obtain just compensation for nearly 30 years. An experienced attorney can advise you of the steps you should take after an accident and how to maximize your recovery once he/she has been retained.

There are certain things you should and should not do following an accident:

• You should always call the police and request that a report be made.
• Get the name, address, telephone numbers (home, work, cell), insurance information, driver's license number, and vehicle information, including the license plate number, from the other party.
• Get the name, address and telephone numbers (home, work, cell) of any witnesses to the accident.
• Take photographs of the scene and vehicles.
• Take photographs of your injuries (bruises, cuts, etc.)
• If you are injured, seek medical attention as soon as possible. You can go to the emergency room at your local hospital or to your primary care physician. Be sure to tell the doctor exactly how the injury occurred and be specific regarding your symptoms, whether they are physical, mental or emotional.
• DO NOT talk to anyone other than your attorney or doctor regarding the accident. Especially, DO NOT talk to any insurance adjuster or agent.
• DO NOT sign anything without consulting your attorney.

In the case of a motor vehicle accident, we can also help you recover PIP and/or Med-Pay benefits from your own insurance company to help pay your medical bills, leaving you a larger amount of compensation from any settlement or judgment against the person who caused your injuries.

Most personal injury cases settle rather than having to go to trial, but, in some cases, that is just not possible. We will always pursue whatever avenue is in your best interest.

It is important for you to know that, in Maryland, the statute of limitations (the time in which you must file a claim) is generally three years from the date of injury or death. After that any claim for damages is barred by law.
